These Terms of Service (“Terms”) govern your access to and use of the website operated by NZ Packaging Limited (trading as NZ Packaging), including any purchases made through https://nzpackaging.nz (“the Website”). By accessing or using the Website, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use the Website.
1. About Us
NZ Packaging Limited is a registered New Zealand company operating from 2/7 Saltmarsh Lane, Richmond, Nelson, 7020, New Zealand. We supply packaging, business consumables, cleaning and hygiene products, safety and protective wear, and related industrial supplies to businesses and individual consumers throughout New Zealand.

2. Eligibility
The Website is available to both business customers and individual consumers. By placing an order, you confirm that you are at least 18 years of age or have the authority to act on behalf of a business entity.
3. Trade Accounts
Approved trade account customers receive access to wholesale pricing and payment on credit terms. Trade accounts are subject to a separate Trade Account Application and approval process.
Standard trade account payment terms are the 20th of the month following the date of invoice, unless otherwise agreed in writing. We reserve the right to suspend or revoke trade account privileges if payment terms are not met.
We may charge interest on overdue accounts at a rate of 1.5% per month (or the maximum rate permitted by law, whichever is lower) on any outstanding balance past the agreed due date.
4. Orders and Pricing
All prices displayed on the Website are in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise stated. GST will be added at checkout where applicable.
We make every effort to ensure pricing accuracy on the Website. However, if an error is identified, we reserve the right to cancel or amend the order and will notify you promptly. You will not be charged for any cancelled order, or will receive a full refund if payment has already been processed.
An order is not accepted until we have confirmed it via email or dispatched the goods. We reserve the right to decline any order at our discretion.
5. Order Cancellation by Us
We reserve the right to cancel any order at any time prior to dispatch, for any reason, including but not limited to stock unavailability, pricing errors, suspected fraudulent activity, inability to verify order information, or any other reason at our sole discretion.
If we cancel an order, you will receive a full refund of any amount already paid. Refunds will be processed to the original payment method within 5–10 business days.
We are not liable for any loss, cost, or damage arising from the cancellation of an order.
6. Payment
Payment for online orders may be made by credit card or debit card. Approved trade account holders may place orders on account in accordance with their agreed payment terms.
All payments must be made in New Zealand Dollars.
7. Stock Availability and Backorders
Stock levels displayed on the Website are indicative and are updated regularly but may not reflect real-time availability. Products shown as “in stock” are subject to availability at the time of processing. If the quantity you order exceeds our stock on hand, the available portion of your order may be dispatched immediately and the remaining quantity placed on backorder.
Backordered items will be dispatched as soon as stock becomes available. There is no fixed timeframe for backorder fulfilment, as this depends on supplier lead times and product availability. We will keep you informed of any significant delays.
If you wish to cancel a backordered item at any time before it has been dispatched, please contact us at sales@nzpackaging.nz and we will cancel and refund that portion of your order in full.
8. Shipping and Delivery
We ship to addresses within New Zealand only. Delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by courier services, weather events, or other circumstances beyond our reasonable control.
Where an order is fulfilled in multiple shipments (for example, due to partial backorders), we will not charge additional shipping for subsequent shipments of the same order.
Risk of loss and damage passes to you upon delivery of the goods to the delivery address provided. Please inspect goods promptly upon receipt and report any damage or discrepancies within 48 hours.
9. Returns and Refunds
Returns and refunds are governed by our separate Return and Refund Policy, which forms part of these Terms. A summary of key points:
• Returns must be requested within 30 days of delivery.
• Products must be in original, unused, and resaleable condition with all packaging intact.
• Custom-made or special order products are non-returnable.
• A 15% restocking fee applies to approved returns of standard stock items.
• The customer is responsible for return shipping costs unless the product is faulty or incorrectly supplied.
• Faulty or damaged goods will be replaced or refunded at our discretion.

10. Product Information
We endeavour to provide accurate product descriptions, images, and specifications on the Website. However, we do not warrant that all information is complete, current, or error-free. Product images are for illustrative purposes and may differ slightly from the actual product in colour, dimensions, or packaging.
11. Intellectual Property
All content on the Website — including text, images, logos, graphics, and software — is the property of NZ Packaging Limited or its licensors and is protected by New Zealand and international intellectual property laws. You may not reproduce, distribute, or use any content from the Website without our prior written consent.
12. Acceptable Use
You agree not to use the Website in any way that:
• Is unlawful, fraudulent, or harmful
• Involves scraping, data mining, or automated collection of content or data from the Website
• Attempts to gain unauthorised access to any part of the Website, other accounts, or systems connected to the Website
• Interferes with or disrupts the operation of the Website
• Creates false or misleading accounts or orders
We reserve the right to suspend or terminate access to the Website for any user who breaches these acceptable use provisions.
13. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or your use of the Website is limited to the amount you paid for the relevant goods or services.
We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, revenue, or data, arising from your use of the Website or products purchased through it.
Nothing in these Terms excludes or limits liability that cannot be excluded under New Zealand law, including under the Consumer Guarantees Act 1993 (where applicable to consumer transactions).
14. Consumer Guarantees Act
If you are purchasing goods as a consumer (as defined in the Consumer Guarantees Act 1993), your rights under that Act are not affected by these Terms. If you are purchasing goods for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by section 43 of that Act.
15. Privacy
Your personal information is collected, used, and stored in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
16. Website Availability
We do not guarantee that the Website will be available at all times or that it will be free from errors, viruses, or interruptions. We may suspend or discontinue the Website or any part of it at any time without notice.
17. Third-Party Links
The Website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them.
18. Dispute Resolution
If a dispute arises in connection with these Terms or your use of the Website, the parties agree to first attempt to resolve the dispute through good-faith negotiation. Either party may initiate this process by providing written notice of the dispute to the other party.
If the dispute is not resolved within 20 working days of the initial notice, either party may then pursue formal legal proceedings. Nothing in this clause prevents either party from seeking urgent interim relief from a court where necessary.
19. Amendments
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Website after any changes constitutes acceptance of the revised Terms.
20. Governing Law
These Terms are governed by the laws of New Zealand. Subject to the dispute resolution process above, any disputes arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the New Zealand courts.
